Supreme Court Takes Up Petition Against Kerala HC Order on Hospital Service Lists and Package Rates

On December 16, 2025, the Supreme Court agreed to hear a petition against a Kerala High Court order. The High Court had directed clinical establishments to show a list of services and package rates in Malayalam and English. This list must be displayed at the reception and on official websites. It also required that hospitals maintain a complaint desk with unique reference numbers for every grievance, sending acknowledgements immediately via text, WhatsApp, or physical form.
The petition was filed by the Kerala Private Hospitals Association and Hussain Koya Thangal. Senior advocates Gopal Sankaranarayanan and Zulfiker Ali P.S. represented them before the Supreme Court. The Bench of Justices Vikram Nath and Sandeep Mehta issued notice to the Kerala State government on the matter.
The court ordered that no coercive action be taken against hospital members until the next hearing on February 3, 2026. It also stated that members may continue registering under Section 19 of the Kerala Clinical Establishments (Registration and Regulation) Act, 2018. Solicitor General Tushar Mehta was asked to assist the court in the case.
