The Delhi High Court has set aside non-bailable warrants (NBWs) against UK-based entrepreneur Sachin Dev Duggal in an Enforcement Directorate (ED) money laundering case connected to Videocon. The court's order on December 19 stated that NBWs can only be issued if the person is accused of a non-bailable offence and is evading arrest. However, Duggal was listed only as a witness in the investigation. The court pointed out that Section 73 of the Criminal Procedure Code (CrPC) allows NBWs if the person is a convict, a proclaimed offender, or an accused evading arrest. "In the present case, it is not the case of the respondent that the petitioner was ever an accused or was evading arrest," the court said. This led the court to quash the special court's February 2023 order that had authorized the NBWs against Duggal. The High Court emphasized that the issue of NBWs must strictly follow legal norms and cannot be extended wrongly to witnesses. This ruling comes as a notable check on the powers of investigative agencies in issuing arrest warrants.
