Supreme Court Rejects Plea to Stop PMO’s Chadar Offer at Ajmer Dargah Amid Temple Dispute

A Special Vacation Bench of the Supreme Court, led by Chief Justice Surya Kant, refused to hear an urgent plea on December 22, 2025. The plea sought to stop the Prime Minister’s Office from offering a ceremonial chadar at the Ajmer Dargah during the Urs festival.
The lawyer argued that the chadar offer would send a wrong message as a case filed by Vishnu Gupta, president of Hindu Sena, is pending. The suit claims the dargah was built over the ancient Bhagwan Shri Sankatmochan Mahadev Virajman Temple. The lawyer said the issue concerns millions of devotees and the chadar offer could prejudice the plaintiff’s rights.
Chief Justice Surya Kant refused to list the case on the same day, saying, “No, I will not list any matter today. We are not listing any matter the same day.” When asked to list it on December 26, the Chief Justice said, “For that, you follow the procedure.”
The Court is closed for winter vacations until January 5, 2026. It had already announced it would hear urgent cases again either on December 26 or December 29.
The Rajasthan court had issued notices on the suit to the Ajmer Dargah Committee, Archaeological Survey of India (ASI) and Union Ministry of Minority Affairs in late 2024. The suit demanded an ASI survey of the dargah to confirm if remains of a Shiva temple exist there.
The plaintiff cited temple-like architectural features and said a Shiva Linga existed beneath the dargah. The suit claimed this violated Article 25, the right to religion.
In December 2024, the Supreme Court barred civil courts from registering fresh suits or passing orders to reclaim temples alleged destroyed by Mughal invaders in the 16th century. This included banning surveys of religious sites under pending cases. The top court is hearing petitions challenging the Places of Worship Act of 1991, which protects religious places’ status as on Independence Day.
