Tamil Nadu Waqf Board Claims Thirupparankundram Hill Summit Belongs to Dargah; Dispute Over Deepam Lighting

The Tamil Nadu Waqf Board told the Madurai Bench of the Madras High Court that the 1920 Original Suit judgment says the summit of Thirupparankundram hill and its nearby areas, including where the stone pillar (deepathoon) is, belong to a dargah. A Division Bench of Justices G. Jayachandran and K.K. Ramakrishnan continued hearing appeals against Justice G.R. Swaminathan's order. The order directed the Subramaniya Swamy temple management to light the Karthigai Deepam at the deepathoon, besides the usual locations.
Advocate R. Abdul Mubeen, representing the Waqf Board, said the judgment explained that the steps from Nellithope, the hill summit, and a mandapam belong to the dargah or mohammedans. He added that the stone pillar or deepathoon was reachable from the dargah. He suggested the issue could be settled through court-monitored mediation.
Senior Advocate Vikas Singh, representing the Madurai Collector and Police Commissioner, said calling the stone pillar a deepathoon was imaginary. He said no previous orders mentioned the deepathoon. The petitioner never mentioned it to temple authorities. Singh said the petitioner had no legal right to demand lighting the deepam at the deepathoon. Yet, the Single Bench issued orders favouring the petitioner. He said the people of Thirupparankundram lived peacefully before this. Singh warned the order created tension, wrongly suggesting Tamil Nadu opposes Hindus. He urged the State to consider public order.
The senior counsel for petitioners argued that the State wrongly claimed the deepam lit only at Uchipillaiyar temple was the norm. The temple's Executive Officer had no authority to answer the petition; only the temple board could. The 1996 judgment allows lighting the deepam at places other than current spots. They said the State could manage any problems from this order. "Acknowledged rights should be given effect to. There was nothing to interfere with the Single Bench order," said the petitioners' counsel.
The court will continue hearing the appeals on Wednesday.
