Calcutta High Court Refuses Stay on Babri Masjid Replica in West Bengal

The Calcutta High Court on Friday, December 5, 2025, declined to stop the construction of a mosque modelled on Ayodhya’s Babri Masjid. The mosque is planned at Beldanga in Murshidabad district, West Bengal. The proposal comes from suspended Trinamool Congress MLA Humayun Kabir.
This decision came just before the foundation-laying ceremony set for December 6, the anniversary of the demolition of the original Babri Masjid.
A division bench headed by Acting Chief Justice Sujoy Paul heard a public interest litigation (PIL) filed against the ceremony. The PIL asked for a stay, warning the event might disturb communal peace in the area.
The court refused the stay and said the West Bengal government is responsible for maintaining law and order.
The PIL argued that Mr. Kabir’s hateful and provocative remarks threaten public harmony. It said, “The MLA has been using filthy and derogatory statements and hate speech against a community, which causes breach of public tranquility.”
Humayun Kabir was suspended by the Trinamool Congress on Thursday for what they called "communal politics." Following this, he announced plans to resign as MLA and start a new party later this month.
This case highlights tensions in West Bengal as religious and political disputes escalate ahead of the mosque’s foundation laying.
