A sessions court in Jammu and Kashmir acquitted three people accused of terror activities due to lack of evidence. The court, led by Additional Sessions Judge Manjeet Rai, said the prosecution failed to prove its case beyond reasonable doubt. The accused—Wajid Ahmad Bhat, Masrat Bilal Bhuru, and Rameez Ahmad Dar from Kulgam district—were arrested on October 10, 2022, at a checkpost in Batamaloo city. Authorities alleged the three had grenades and magazines with live rounds. However, the court found serious gaps in the prosecution's case. Judge Rai said, "The present case is marked by material discrepancies about how the accused came to be apprehended and what exactly was recovered from whom." The judge noted failures to record identifying marks on seized items and to preserve seal impressions, which broke the chain of custody. Contradictory evidence about sealing and showing grenades to the bomb disposal squad was also highlighted. Witnesses struggled to correctly identify the accused or link grenades to them. There were no independent or supporting witnesses to back up terrorism charges linked to Al-Badr or any planned terror acts. The court stated, "Once such doubt arises, the accused are entitled to benefit of doubt. The prosecution has failed to establish beyond reasonable doubt that the accused were in conscious and unauthorised possession of the alleged grenades, magazine and rounds on 10.10.2022 at Command Post Batamaloo." Judge Rai directed that the accused be released immediately if not needed in other cases. The accused were represented by lawyers Mir Urfi, Waheed Ahmad Dar, and Anil Raina. The verdict was delivered on Monday, December 29, 2025.
