Supreme Court Warns NHAI: Winter Darkness and Poor Highway Conditions Fuel Deadly Accidents

On December 15, 2025, the Supreme Court expressed concern over deadly highway accidents linked to poor road conditions and winter darkness. The court told the National Highways Authority of India (NHAI) that lack of streetlights, illegal dhabas, and careless vehicle parking are leading to tragic loss of lives.
A bench of Justices J.K. Maheshwari and Vijay Bishnoi was unhappy with NHAI's affidavit blaming local police and authorities. Justice Maheshwari said, "The NHAI is just throwing mud at police and local authorities. We want to know about the powers of the NHAI and the corresponding action it can take if the administration is not doing anything."
Solicitor General Tushar Mehta assured the Supreme Court that the Centre and NHAI will study the rules and respond properly.
The court noted that illegal eateries on highways cause drivers to park vehicles on road edges, worsening risk during winter due to poor visibility. Justice Bishnoi said, "It gets worse during the winter."
The Supreme Court took suo motu notice after a November 2 accident in Rajasthan's Phalodi killed 15 people when a tempo crashed into a truck parked near a highway eatery. The tempo carried women and children returning from pilgrimage.
On November 3, a lorry collided head-on with a bus on NH 163 in Telangana when the driver swerved to avoid a pothole. This accident killed 19 people, including a three-month-old girl.
The Supreme Court is pushing the NHAI to find solutions and prevent further tragedies on Indian roads.
