Lawyers Oppose Impeachment Motion Against Justice G.R. Swaminathan, Call It Baseless

A group of senior advocates and other lawyers from the Madurai Bench of the Madras High Court have called the impeachment move against Justice G.R. Swaminathan "baseless" and warned it crosses the "Lakshman Rekha" separating the legislature and judiciary. In a memorandum submitted to the Lok Sabha Speaker, they said the motion by some MPs is a direct attempt to weaken the judiciary in India. They described it as "a high-handed application of one of the most extraordinary provisions of the Constitution." The lawyers shared their letter with the media on December 13, 2025.
The memorandum said this attempt is "a brazen breach and misuse of the Constitutional powers" by certain MPs. It avoided commenting on the details of the dispute involved, as it is still under appeal in higher courts.
Justice Swaminathan has a record of delivering justice with fairness and integrity. Between June 2017 and November 2025, he disposed of 1,26,426 cases, including 73,505 main cases. The lawyers said the impeachment move shows "sheer bigotry and vested interests" against democracy and the Constitution's principle of separation of powers.
They urged the Lok Sabha Speaker not to accept the impeachment motion, highlighting Justice Swaminathan's honesty and intelligence as a judge of the Madras High Court. The memorandum requested the Speaker to reject the motion quickly using Articles 124(4) and 217 of the Constitution, along with the Judges (Inquiry) Act, 1968, to uphold the law's dignity.
